Consequently, the Standard Import Procedure Report must be filed as 'cosmetic raw materials,' and clearance should proceed under the corresponding HS Code. It is important to note that bulk products may carry different HS Codes (e.g., specific chemical mixtures or preparations) compared to finished goods, which can influence the applicable tariff rates.
Under the Korean Cosmetics Act, the acts of filling and packaging are considered part of the manufacturing process. Even if the activity only involves transferring the product into containers and applying labels, it is legally classified as 'manufacturing.' Therefore, the domestic entity performing these tasks must hold a valid Cosmetic Manufacturer Registration. Conducting these activities without proper registration is a violation of the law and may result in administrative sanctions.
Once the manufacturing process is finalized in Korea, the product must meet specific requirements before it can be distributed in the market. A registered Responsible Cosmetic Distributor must report the product details and production performance to the Ministry of Food and Drug Safety (MFDS). Only after these steps are completed does the product gain the legal status of a 'finished cosmetic product' ready for local distribution.
