Mandatory Requirement for New Business Registration

To conclude, the import declaration agent system under the previous Food Sanitation Act was abolished upon the enforcement of the Special Act. Therefore, existing registrations are not automatically converted or maintained as valid under the new regulatory framework. Because the legal structure has transitioned to a completely new system, a fresh registration is mandatory.



Regulatory Background and Transition

The Special Act was enacted to strengthen the safety management of food products imported into Korea, separating these regulations from the general Food Sanitation Act to establish a more specialized and robust management system. Under this transition, the management of businesses related to imported food has become more granular and clearly defined. Consequently, entities previously acting as import declaration agents must newly register as an "Import Declaration Agency Business" under the Special Act to continue their operations legally.



Recognition of Existing Hygiene Training

While a new registration is required, the following provision has been made to reduce administrative burdens on existing operators:

  • Hygiene Training Recognition: Hygiene training previously completed under the Food Sanitation Act is officially recognized as meeting the requirements for the new registration under the Special Act.
  • This measure ensures that existing business owners do not face redundant educational requirements during the transition.

New business registrations should be submitted to the Regional Office of Food and Drug Safety that has jurisdiction over your business location.
