When importing electrical appliances into South Korea, compliance with the Electrical Appliances and Consumer Products Safety Control Act is mandatory. This regulation is designated under Article 226 of the Customs Act as a requirement for 'Items Subject to Confirmation by the Collector of Customs.'



Mandatory Compliance and Submission Requirements

If the electrical appliances you intend to import are subject to safety certification, you must obtain the necessary certification from the relevant authority prior to filing the import declaration. This requirement applies regardless of whether the customs office explicitly requests the documentation for a specific shipment.

According to Article 245, Paragraph 1 of the Customs Act and Article 250, Paragraph 2 of its Enforcement Decree, importers are legally obligated to attach certification documents or certificates of exemption during the import declaration process. Customs performs document reviews and physical inspections on a selective basis to verify that these legal requirements are met.



Legal Risks of Non-Compliance

  • Strict Obligation: Even if the customs office does not request materials for a particular shipment, the legal obligation to hold valid safety certification remains.
  • Penalties for Illegal Distribution: Distributing uncertified or illegal products in the domestic market following customs clearance is a violation of the law and is subject to criminal prosecution and administrative sanctions.
  • HS Code Misclassification: Attempting to bypass certification by intentionally misclassifying HS codes is a serious illegal act. Even if not detected at the time of clearance, such violations are often identified during post-clearance audits or market distribution monitoring, leading to severe penalties.
